We take pride in our contract and will always revert back to it in any situation which deals with a puppy or sale. Please read through the contract carefully before signing it. The contract is to protect the puppy, its wellbeing, and either the seller or buyer.

Upon payment of the sum of $00.00 paid by Buyer to Seller (the “purchase price"), receipt of which is hereby acknowledged, Seller grants, sells, conveys and transfers ownership of the following (the “dog") to buyer:

The parties accept and agree to be bound by the attached Terms and Conditions, governing the purchase and sale of the dog. IF FOR ANY REASON DUE TO THE SAFETY AND HEALTH OF SAID PUPPY/DOG SELLER HAS THE RIGHT TO VOID THIS CONTRACT. I THE BUYER UNDERSTAND THE DEPOSIT IS NON-REFUNDABLE UNLESS THE PUPPY DIES IN SELLERS HANDS.

TERMS AND CONDITIONS

Deposit, Payment of Purchase Price, Fees
Buyer has paid a non-refundable deposit of $00.00. The remaining balance of $00.00 plus delivery is due in cash at time of receiving puppy. The expected delivery date is September 11, 2024 such other date as both parties may mutually agree. Payment of deposit can be paid by paypal, venmo, zelle or by other methods with pre-approval. Final payment can be paid by cash, cashiers check, money order.
Buyer acknowledges and agrees to the non-refundable deposit under any circumstances, if for any reason the puppy sale is canceled.
In either event Seller shall be free to sell the dog to another party.
If Buyer returns said puppy for any reason the deposit is non-refundable. All AKC paperwork and veterinarian book shall be returned to Seller with puppy or none of Purchase Price will be refunded. Seller will full rights to sale said puppy.
A boarding fee of $20.00 per day will be charged each day the dog is boarded by Seller past the agreed delivery date.
2. TRANSFER OF OWNERSHIP AND REGISTRATION
Upon payment in full of the Purchase Price, Seller (at Seller's sole cost) shall promptly take all actions required to transfer ownership and registration (if applicable) of the dog to the Buyer.
3. SELLER’S REPRESENTATIONS AND WARRANTIES
Seller represents and warrants to Buyer that:

Seller is the true and legal owner of the dog and that Seller has full rights and authority to sell the dog.

The dog is being sold free and clear of any lien, security interest, charge or other encumbrance.

Seller guarantees that the dog is a purebred dog, offspring of the purebred sire and purebred dam set out on page 1 of this agreement.

The dog is in good health and free of communicable diseases at the time of this sale. Buyer has 3 days from the delivery date to have the dog examined by a licensed veterinarian, at Buyers Sole cost. If the dog fails the examination, Buyer may return the dog with a written letter, tests, x-rays, etc from the veterinarian to Seller’s Veterinarian. If Buyer returns puppy due to medical reasons Seller has 10 days for 2nd opinion. If there is conflict in the 2 vet reports then Sellers vet will take priority over Buyers vet as they have been primary vet since birth. If Seller’s vet finds puppy has no genetic issues, then buyer will not receive full refund. If Buyer chooses to return puppy for what they believe to be a medical reason. After appointment with Seller’s choice of vet decision will be made. Refund upon approval will be prorated by: less non-refundable deposit, less vet bill, then 50% of remaining balance. All AKC paperwork, vet book, etc must be returned before receiving alloted refund. Failure by Buyer to have dog examined by veterinarian within the 3 day period will nullify this warranty. If Buyer chooses to keep the puppy, no replacement will be given and all medical costs and treatment are sole responsibility of the Buyer. This health guarantee will become null and void including the genetic health guarantee.

This guarantee does NOT cover allergies, un-descended testicle, loose knees, or hips, umbilical hernia, dermatitis, demodectic mange. Seller will NOT replace a dog due to heat stroke, abuse/neglect, or improper socialization. Seller has fully explained the dog has only received 1st set of shots and will be the Buyer’s responsibility to complete the shots and until said time they are NOT protected from parvo and other diseases. If Buyer’s do NOT do follow up shots or expose the dog after receiving it on delivery date Seller is not responsible and this will null and void. This guarantee covers only the original Buyer and is NOT transferable.

There is a (2) two year Genetic health guarantee against Genetic health only issues that are tested by Embark Vet at the time of purchase, except IVDD. Buyer is responsible to have veterinarian examination and provide documentation to the Seller’s Veterinary of her choice at the Buyers sole cost. Seller has the right to have dog taken to a veterinarian for 2nd opinion at the sole cost of the Seller. If the dog is proven to have a Genetic health issue that is tested by Embark Vet at time of purchase, the Seller will have the option to offer to Buyer return of dog for full refund, keep dog with partial refund to be determined by Seller or return of dog for choice of different dog. This is for (2) two years only and to original Buyer NOT transferable.

The Buyer agrees to NOT have the dog euthanized, unless due to medical issues, or take to a animal shelter or to sale or use for dog fighting. Buyer will notify Seller if for any reason Buyer can no longer keep the dog, which at that time Seller has first option to take dog back, price if any to be determined. At most buy back will be 50% of Purchase Price minus deposit plus travel expense to get dog. You must have permission from Seller to rehome the dog to anyone.
4. BUYERS REPRESENTATIONS
Buyer represents to Seller that:

Buyer agrees to have the dog spayed or neutered by the age of six months, unless having medical issues then must provide veterinarian documentation. Proof of operation must be sent immediately to Seller, if this is not provided Seller has full rights to remove dog from the Buyer’s home at the expense of the Buyer. At that time the dogs ownership will reverse back to Seller with no money being refunded. This is only if AKC with full rights was not purchased.

Buyer agrees the dog will be kept in a enclosed area of adequate size, and the dog will not be allowed to roam at will. Buyer agrees to NOT keep the dog chained or tethered or permanently housed in a dog crate/kennel. If it found this is happening the dog can be removed by the Seller.

Buyer agrees to provide the dog with nutritious food and necessary veterinary care, including but not limited to de-worming, heartworm prevention and regular yearly vaccinations after receiving remainder puppy shots (including rabies).

Buyer agrees they are NOT acting as agent for any other person or business in the purchase of the dog.

Buyer agrees to NOT sell, give, or release dog to a pet shop, retail store, dog dealer, animal testing facility, research facility, or an agent for any such business or facility.

In the event the Buyer sells the dog to a new owner, Buyer shall ensure that the new owner agrees in writing to comply with the terms of this agreement and have permission from Seller.
5. INDEMNITY AND RELEASE
A. If any action or failure to act on the part of Buyer shall result in any claim, suit, loss, damage, injury, death or liability, Buyer agrees to defend, indemnify, and hold Seller harmless and to pay all of Seller’s costs and expenses, including reasonable legal fees, any amount paid in settlement and any award or judgment with respect thereto. Buyer releases Seller from any and all liability, costs or damages caused by the dog after placement with the Buyer, including but not limited to damage to or destruction of property, and injury to ANY person.
B. Buyer agrees to no slander, bad mouth, trash talk, etc about Briarwood Dachshunds or Barbara Lautt in anyway. That includes but is not limited to social media, dog groups, business, people. If Seller does they can and will be held accountable by a court of law.
6. LIMITATION OF ACTION
Any action or claim brought by Buyer against Seller for breach of this agreement or for loss due to negligence must be brought within (1) one year of the date such claim or loss occurs.
7. GOVERNING LAW
This agreement shall be governed by and construed in accordance with the laws of the State of Idaho.
8. ENTIRE AGREEMENT
This agreement represents the entire agreement between both Buyer and Seller. Seller and Buyer have made no other agreements, promises representations or warranties, express or implied, unless specifically stated in this agreement.
